kbbcomputers.com , provides World Wide Web page hosting, Dedicated Server Leasing, Reseller Server Leasing, free Web Site Hosting and other services. kbbcomputers.com reserves the right to suspend or cancel a customer's access to any or all services provided by kbbcomputers.com when kbbcomputers.com decides that the account has been inappropriately used or otherwise.


You may not use your dedicated server or virtual site to publish material, which kbbcomputers determines, at its sole discretion, to be unlawful.
 If a kbbcomputers Web Hosting account is used to violate the Acceptable Use Policy or our TOS (Terms of Service), we reserve the right to terminate your service without notice. We prefer to advise customers of inappropriate behavior and any necessary corrective action, however, flagrant violations of the Acceptable Use Policy will result in immediate termination of service.

SERVER USE
Personal accounts and Free Web Sites are to be used by the primary owner only. Personal account and Free Web Sites holders are not permitted to resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

Dedicated, Shared and Reseller Server leasing may however resell our Reseller or their own Reseller packages.

The Operating system, The Control Panel, WebHost Manager programs and parts their of  are the property of kbbcomputers.com. Anyone found trying to copy duplicate or manipulate ( Hacking )the servers will be suspended and if applicable prosecuted to the full extent of the law.

kbbcomputers.com reserves the right to refuse service and or access to its servers to anyone.
You are responsible for any misuse of your account, even if the inappropriate activity was committed by a friend, family member, guest or employee. Therefore, you must take steps to ensure that others do not gain unauthorized access to your account. In addition, you may not use your account to breach security of another account or attempt to gain unauthorized access to another network or server.

· Your password provides access to your account. It is your responsibility to keep your password secure.

· Sharing your password and account access with unauthorized users is prohibited. You should take care to prevent others from using your account since you will be held responsible for such use.

· Attempting to obtain another user's account password is strictly prohibited, and may result in termination of service.

kbbcomputers.com do not allow any of the following content to be stored on its shared servers:
Illegal Material or Material - Includes copyrighted works non copyrighted works, commercial audio, warez, video, or music files, audio or video streaming ,"file dumping" and any material in violation of any Federal, State or Local regulation. Chat scripts or Irc bots, spamming activities
 

Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of kbbcomputers.com .

Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

"file dumping" The posting of files for download or storing of files for distribution commercial or non commercial

The Dedicated Full Servers do support "file dumping" and audio streaming upon our approval.

kbbcomputers Acceptable Use Policy ("AUP") is provided to give our customers and users a clear understanding of what kbbcomputers  expects of them while using the service. All users of kbbcomputers: those who access some of our Services but do not have accounts, as well as those who pay a service fee to subscribe to the Services, must comply with this AUP and our TOS (Terms of Service). This document is intended to provide a basic understand of kbbcomputers  Acceptable Use Policy. UNLIMITED USE POLICY
High bandwidth usage: kbbcomputers.com offers an unlimited use policy by maintaining very large ratios of bandwidth per customer. In rare cases, kbbcomputers.com may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, kbbcomputers.com reserves the right to impose the High Resource User Policy for the consideration of all customers. This policy does not apply to FIXED BANDWIDTH plans.

HIGH RESOURCE USER POLICY
Resources are defined as bandwidth and/or processor utilization.

kbbcomputers.com may implement the following policy to its sole discretion:

When a website is found to be monopolizing the resources available kbbcomputers.com reserves the right to contact and suspend that site. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers.

PAYMENT POLICIES
All accounts are set up on a prepay basis. Although kbbcomputers.com reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established. Customers will automatically be charged again at the end of their prepay period unless closure notification has already been given.

In situations where the card number on file is declined kbbcomputers.com will immediately suspend the facility to purchase services on-line until the outstanding charge is processed successfully. In addition, kbbcomputers.com reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.

No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email shortly after the online purchase has been made. At this point the customer's card will be charged automatically.

PAYMENT OPTIONS
Credit / Debit Cards:
kbbcomputers.com currently uses Pay Pal which accepts Major Credit and Debit Cards and Bank Account Linking. We also accept Credit Cards over the phone ( Master Card, Visa and Discover Card )

Cheque ( Check ) Payment:
This option is only available to customers who pay annually for their kbbcomputers.com account. A credit / debit card number will still be required if customers require the facility to purchase domains and other services on-line. kbbcomputers.com cannot guarantee that a service will be provided until after any received cheques have been cleared.

CANCELLATION AND REFUNDS
kbbcomputers.com reserves the right to cancel the service at any time. If a customer contravenes kbbcomputers.com ' terms of service a refund will be not issued in the event of a cancellation.

Any incentives offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation.

Fees charged on a prepay basis are non-refundable after the money back period. In event that an account has refunded there is an administration fee of approx $10.00 /£10 and account usage will be levied on the account. In addition some "non standard account features" such as Front Page Extensions ,Control Panels, MY SQL, Sql server, Live stats and set up fees are non-refundable. The designation of "non standard account features" is left entirely to the discretion of kbbcomputers.com .

INDEMNIFICATION
Customer agrees that it shall defend, indemnify, save and hold kbbcomputers.com harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against kbbcomputers.com , its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless kbbcomputers.com against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with kbbcomputers.com ' server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from kbbcomputers.com ' server.

DISCLAIMER
kbbcomputers.com will not be responsible for any damages your business may suffer. kbbcomputers.com makes no warranties of any kind, expressed or implied for services we provide. kbbcomputers.com disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by kbbcomputers.com and its employees. kbbcomputers.com reserves the right to revise its policies at any time without Notice.
